These Terms & Conditions apply to painting and related services supplied by Vakker Australia Pty Ltd (“Vakker”, “we”, “us” or “our”). By accepting a written quotation, approving work to proceed, or engaging us to provide services, you agree to these terms.
1. Quotes and scope of work
Our quotations are based on the information available at the time of inspection and the scope described in the quotation. Unless stated otherwise, a quotation covers only the labour, preparation, materials and areas specifically listed. Any additional work, repairs, colours, finishes or areas requested after acceptance may be treated as a variation and priced separately.
2. Pricing and materials
Pricing depends on the condition of the surfaces, preparation required, access, materials, products and finish selected. Where paint or other materials are excluded from the quoted price, this will be stated in the quotation. Product availability, colour choice and manufacturer requirements may affect the final scope or timing.
3. Surface condition and preparation
Painting results depend on the condition of the existing substrate. We use reasonable care and appropriate preparation methods for the surfaces included in the agreed scope. Hidden defects, moisture, movement, previously failing coatings, structural issues, contamination or other conditions that could not reasonably be identified before work starts may require additional preparation or repair.
4. Variations
If additional work becomes necessary or you ask us to change the agreed scope, we will discuss the variation with you before proceeding where reasonably practicable. Variations may affect the price and completion date.
5. Access and client responsibilities
You must provide reasonable access to the property and work areas at the agreed times. Unless otherwise agreed, personal items, fragile objects and valuables should be moved away from work areas before work begins. Please tell us about known hazards, access restrictions, alarm systems, pets, strata requirements or other site conditions that may affect the work.
6. Scheduling, drying times and weather
Start and completion dates are estimates unless we expressly agree otherwise in writing. Painting work may be affected by weather, humidity, drying and curing times, access, product availability, other trades and unforeseen site conditions. Exterior work may need to be postponed or rescheduled when conditions are unsuitable.
7. Payment
Unless otherwise agreed in writing, no deposit is required. We issue an invoice after completion of the agreed work, and payment is due within 7 days after the client has had the opportunity to inspect the completed work. Any different payment arrangement stated in a quotation or invoice will take precedence.
8. Inspection and concerns
Please inspect the completed work as soon as reasonably practicable and let us know promptly if you have any concerns. We will assess any issue relating to our workmanship and, where appropriate, arrange reasonable rectification in accordance with the agreed scope and applicable law.
9. Workmanship, products and warranties
We stand behind our workmanship and use products suitable for the agreed application. Any manufacturer warranty is subject to the manufacturer’s terms, product requirements and exclusions. Nothing in these terms excludes, restricts or modifies any right or consumer guarantee that cannot lawfully be excluded under the Australian Consumer Law.
10. Existing damage and third-party work
We are not responsible for pre-existing damage, defects outside the agreed scope, or damage caused by other trades, occupants, structural movement, water ingress, substrate failure, misuse or events outside our reasonable control.
11. Cancellations and delays
If you need to postpone or cancel booked work, please give us as much notice as reasonably possible. We may need to reschedule where weather, safety, site access, illness, material availability or other circumstances outside our reasonable control prevent the work from proceeding as planned.
12. Photos and project records
We may take photographs of work areas for estimating, quality-control and project-record purposes. We will not intentionally publish identifying personal information without an appropriate basis or permission. If you do not want completed-project photographs used for portfolio or marketing purposes, please tell us.
13. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable Australian privacy law.
14. Australian Consumer Law
Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law where that law applies. These terms are intended to operate consistently with those rights.
15. Governing law
These terms are governed by the laws applicable in New South Wales, Australia. Any dispute will be dealt with in the courts or tribunals having jurisdiction in New South Wales, subject to any rights you have under applicable consumer law.
